11.5 AGE DISCRIMINATION—DEFINITION OF COMMON TERMS

Comment

The ADEA defines several common terms in the same manner as Title VII. As applicable, the following Title VII instructions should be given: Instructions 10.4A.1 ("Adverse Employment Action" in Retaliation Cases), 10.4A.2 ("Adverse Employment Action" in Disparate Treatment Cases), 10.4B ("Tangible Employment Action Defined), and 10.4C (Constructive Discharge Defined).
